GENERAL TERMS AND CONDITIONS

The use of this website, as well as the purchase of products through the online shop of BlueLocar GmbH (from here on referred to as: BlueLocar), is subject to the following terms and conditions:

With the use of this website, and by placing an order through the online shop, you agree to the following terms and conditions.

1. COMMUNICATION WITH BLUELOCAR
When you place an order through the online shop, you agree that all future communication from BlueLocar will take place via email.

2. CONCLUSION OF THE CONTRACT
Contracts can only be finalized with natural and legal persons residing within the European Union.
By clicking the button “complete order”, you are placing a binding order with BlueLocar. This finalizes the contract with the items contained in your shopping cart. When you submit the order to BlueLocar, we will send you order verification via email. This verification will include details of the order. The order verification does not represent an acceptance of your offer. It will only provide verification to you that we have received your order. A contract for purchase will be prepared when we send the ordered product to you, or send you shipping verification via email. If your order is shipped in more than one package, you may receive shipping notification for each individual package. In this case, each shipment will have a separate sales contract for the items shipped.

The contract partner is BlueLocar. The right of cancellation for consumers remains according to item 7. Your order can be canceled at any time, at no additional cost, before the shipping verification is received

Please note that many products on our website are only sold in quantities suitable for general household use. This applies both to the quantities of a product ordered on an individual purchase order, as well as to the total quantities of a product ordered on several purchase orders. This refers specifically to quantities that may, on an individual basis, be suitable for general household use, but far exceed a household quantity when all orders are combined. 3. PRICING
Prices include all taxes and fees, including value added tax. Shipping and delivery costs will be listed separately.

Even though we take the greatest precautions possible, it may happen that on occasion a product may be marked with an incorrect price. We will check all prices before the payment transaction is completed. If the actual price of a product is higher than the marked price on the website, we will contact you before shipping the item and will confirm whether you want to purchase the item at the correct price, or if you would like to cancel the order. If the correct price of an item is lower than the actual price marked, we will adjust the amount on your bill and will ship the item to you.

4. PAYMENT AND RETENTION OF TITLE
The customer can make payment via advance payment, credit card or direct debit.
Each item delivered remains the property of BlueLocar until final payment is made.

5. DELIVERY
Delivery will only take place to addresses within the European Union.
Unless otherwise agreed to, delivery will take place to the address indicated on the order. Unless a different delivery date has been agreed to, we will deliver within 14 days of order placement. You will be notified by email if BlueLocar becomes aware during your order fulfillment that the requested items are not available.
If delivery of the product is not possible because the buyer is not available at the indicated delivery addresses, even though the delivery time was supplied to the buyer with sufficient notice, the buyer is responsible for the costs of the unsuccessful delivery.

6. PRIVACY STATEMENT
Personal data will be processed in accordance with the requirements of the BlueLocar privacy statement. These can be accessed on the following link and can be saved as a PDF file.

7. THE RIGHT OF THE CONSUMER TO RESCIND THE CONTRACT
The right of cancellation of a purchase order is valid for 14 days after the consumer, or a third party designated by the consumer, has taken ownership of said item. The period for cancellation of an order consisting of multiple packages with multiple delivery dates is 14 days after the date upon which the customer, or a third party named by the customer, receives the last package.

In order to rescind a contract, the consumer must contact BlueLocar (BlueLocar GmbH, Autokaderstraße 29/Bauteil 2, A-1210 Vienna, Austria, office@bluelocar.com). The notification must include a specific statement through a verifiable channel (e.g. a letter sent through the mail, fax, or email) pursuant to the customer’s decision to cancel the order. The consumer may use the included sample cancellation form for this. Use of the form is not required. The customer must return the notification of cancellation within the 14-day cancellation timeframe in order for the request for cancellation to be honored.

Upon cancellation of an order:

When you cancel an order, we are required to return all payments received from you including shipping costs. (Exception: additional costs incurred by the consumer because a different shipping method was selected other than standard shipping will not be refunded). Refund must be made immediately and at the latest within 14 days of the receipt for request of cancellation. We will use the same method for refund that was initially used for the purchase, unless the customer specifically requests, and we agree to, a different form of payment. In no case will fees be charged to you due to this cancellation. We have the right to hold the refund either until we receive the product, or until we receive verification from you that the product has been shipped to us, whichever occurs first.

The customer must pay shipping costs for returned items.

The product must be returned in unused, new and sellable condition. The product must be in its original packaging. If the product shows signs of use or any damage caused by you, you are required to reimburse us for the loss of value. This applies as long as the damage was not caused by the normal and regular inspection of the item. The same requirement for reimbursement applies if parts or attachments are missing upon receipt of the item.

The following applies in the case of a contract for services:

If you have requested that the services start within the cancellation period, you will be required to pay for the work completed up to the point where you inform us of your cancellation. This is in comparison to the total amount of the services outlined in the contract. Contracts for services may only indicate a start time within the cancellation timeframe, and work will only begin during the cancellation timeframe, when the customer specifically requests it (early contract performance) via email or on paper

8. WARRANTY
Contracts are subject to legally required warranties. The warranty period is two years and begins on the day that the item is received by the customer. Claims based on legal warranty issues may be made to the following address:

9. CHANGES IN THE TERMS AND CONDITIONS OF SALES
We reserve the right to change our website, policies, and terms and conditions including those contained in this document. The terms and conditions of sale, contract terms, and general terms and conditions, which were in effect at the time of your order, will apply to your purchase. The only exception to this are any changes made due to changes in the law or official directives. In these cases, the new terms and conditions will apply even to orders that you have previously finalized.

10. TRANSLATIONS
Every translation of the German version of these General Terms and Conditions is of a non-binding nature. In the event of differences between the translated versions and the German version of these conditions, only the German version is legally binding.

11. WAIVER
In the case that a customer violates these terms and conditions and we waive any right or remedy arising from this breach, this does not constitute a waiver of any right or remedy arising from any other breach of the terms and conditions.

12. FINAL PROVISIONS
The terms and conditions of all contracts that are finalized are based on Austrian law. The use of international conflict rules and UN purchasing law is excluded. The exclusive place of jurisdiction is Vienna, Austria, so long as the applicable consumer protection provisions for consumer companies do not specify differently. These General Terms and Conditions and all contracts finalized according to them can only be changed, or additions made to them, in writing. Should a condition of the general terms and conditions become invalid and/or incomplete, it will be replaced by a different condition that is legally enforceable. If individual conditions of these General Terms and Conditions are not in line with imperative legal regulations, this will not affect the other terms and conditions contained herein.

13. MINORS
We do not offer any products for purchase by minors. If you are under 18, you may only use bluelocar.com with a parent or a legal guardian.
